Alert: Foreigners working without Work permits in Vietnam may face deportation

Mr. Dao Ngoc Dung, Minister of Labor, War Invalids, and Social Affairs, has just issued Official Letter No. 03/CD-LDTBXH to the Chairman of the People’s Committees of the provinces and centrally-run cities on strengthening management of foreign workers in Vietnam.

  • The Ministry’s cable emphasized that the COVID-19 epidemic in the world and the country is extremely complicated and is on the rise. The situation of foreigners entering the country illegally and to find work is occurring in many areas throughout the country.
  • The Minister proposed the following candidates for Chairman of the People’s Committees of the provinces and centrally-run cities.
  • Examine all establishments and businesses in the area that employ foreign workers. Strengthen inspection and examination, and strictly deal with establishments and enterprises that receive and use illegal laborers. As well as cases of deliberate violations of the law, on that basis.
  • Check and correct the issuance of work permits for foreign workers in the area, ensuring the correct conditions, order, and procedures specified in the Government’s Decree No. 152/2020/ND-CP dated December 30, 2020, and Clause 1, Article 152 of the Labor Code 2019.
  • Simultaneously, authorities are considering deporting foreign workers who work in Vietnam but do not have a work permit (or written confirmation that they are ineligible for a work permit) and do not comply with regulations. The law governing foreigners’ entry, exit, transit, and residence in Vietnam.
  • Direct the organization of epidemic prevention and control inspections at establishments and enterprises employing foreign workers in the area. Ensuring strict adherence to 5K requirements and health authority regulations. Firmly suspend and strictly prosecute establishments and businesses that fail to ensure safety by the law.
  • The review findings will be forwarded to the Ministry of Labour, Invalids, and Social Affairs (via the Working Department) by May 25 for summarization and reporting to the Prime Minister.
